Who Can You Sponsor?

Your common-law partner:

  • Cannot be legally married to you

  • Can be of any gender

  • Must have lived with you continuously in a conjugal relationship for at least 12 consecutive months without long separations

    • Any time spent apart must be brief and temporary

Important: If either partner ends the relationship, it is no longer recognized by Immigration, Refugees, and Citizenship Canada (IRCC). You must provide proof of cohabitation to validate a common-law relationship.


🔹 Conjugal Partner

Your conjugal partner:

  • Is not legally married to you

  • Is not in a common-law relationship with you

  • Must be at least 18 years old

  • Has been in a committed relationship with you for at least one year

  • Lives outside Canada

  • Is unable to live with you or marry you in their home country due to serious barriers such as:

    • Marital status (e.g., still legally married where divorce isn’t an option)

    • Sexual orientation (e.g., same-sex relationships are not accepted or legal)

    • Religious or cultural persecution (e.g., interfaith relationships are forbidden)

You must provide evidence that living together or marrying in their country was not possible, such as documentation of refused visas or legal prohibitions.

Dependent Child Sponsorship

Canada’s Dependent Child Sponsorship Program allows Canadian citizens and permanent residents to sponsor their dependent children to immigrate and live with them in Canada. This program is part of Canada’s commitment to family reunification.

Who Qualifies as a Dependent Child?

A child is considered dependent if they:

  • Are under 22 years old

  • Are not married and not in a common-law relationship

Children 22 years or older may still qualify if they:

  • Are unable to support themselves due to a physical or mental condition


✅ Sponsorship Criteria

A child may be sponsored if their parent meets the following conditions:

  • Is a Canadian citizen, a permanent resident, or a person registered under the Canadian Indian Act

  • Is not sponsoring a spouse or partner along with the child (in which case, the child becomes the principal applicant)

  • Can provide proof that the other biological parent or legal guardian consents to the child immigrating to Canada

If the child has children of their own, they can also be included in the application as dependents.

Note: If you’re an adopted child or an orphaned relative, your application must follow a different set of sponsorship guidelines.

Parent and Grandparent Sponsorship
